The Challenge
Lenders may be under attack by junior creditors or the borrower, or face a threat of litigation. Article 9 requires a foreclosing lender to conduct a “commercially reasonable” sale process in connection with foreclosing on its collateral.
Our Solution
We conduct the required commercially reasonable sale process. Lenders engage us to insulate the process from challenge and, if it is challenged, to provide a credible defense that the standard was met. At the conclusion of the sale, clients receive a Declaration of Commercial Reasonableness detailing the efforts undertaken to achieve a commercially reasonable sale – a reliable foundation should the sale be attacked.
